1. Who we are
Capy / miCapy ("Capy," "we," "us," or "our") is operated by Capy Technologies E.A.S..
Capy provides CRM tools, lead management, analytics, and messaging assistance for real estate professionals, including integrations with WhatsApp Business.
This Privacy Policy explains how we collect, use, share, and protect personal data when you use our website, applications, integrations, and related services at micapy.com and other channels associated with the Service.
2. What Capy does
Capy helps real estate agents and agencies manage leads, properties, conversations, follow-ups, and business opportunities in one place.
When a business customer connects their WhatsApp Business account, Capy processes WhatsApp Business messages and related data on behalf of that business customer. This may include syncing conversations, extracting lead and property information, generating suggested replies, creating reminders, classifying leads, and providing analytics.
The business customer using Capy is responsible for informing its own leads and contacts that their communications may be processed using CRM, automation, and artificial intelligence tools, when applicable law or WhatsApp/Meta policies require it.
3. Data we collect
We may collect and process the following categories of data.
Account data
Name, email address, company or agency name, phone number, role, access credentials, and other data associated with your Capy account.
WhatsApp Business and Meta account data
When you connect a WhatsApp Business or Meta integration, we may process data such as business name, phone number, WhatsApp Business account ID, WABA ID, connected account IDs, message templates, number status, authorized permissions, and Meta/WhatsApp webhook events.
Message data
We may process content and metadata from connected WhatsApp Business accounts, including message text, timestamps, sender and recipient phone numbers, replies, reactions, status updates, conversation history, media metadata, and other related events.
Lead and contact data
Names, phone numbers, budget, location preferences, property criteria, transaction type, notes, lead status, follow-up history, reminders, and other information stored or generated in the CRM.
Property data
Listing URLs, property details, prices, locations, availability, features, photos, media URLs, notes, and other information related to properties managed or analyzed in Capy.
Usage and technical log data
IP address, browser and device information, technical identifiers, actions taken in the application, logs, error records, and data used for security, monitoring, debugging, and Service improvement.
AI and automation data
Extracted lead fields, search criteria, suggested replies, classifications, reminders, summaries, analytics, and other results generated from conversations, properties, and CRM activity.
4. How we use data
We use personal data and Customer Data to:
- provide CRM, lead management, property, and messaging features;
- sync, store, and display connected WhatsApp Business conversations;
- extract information from leads, contacts, and properties;
- generate suggested replies, reminders, classifications, summaries, and analytics;
- send or receive WhatsApp messages when the connected agent, agency, or business authorizes it;
- administer accounts, integrations, permissions, and technical support;
- maintain Service security, prevent abuse, and detect unauthorized activity;
- debug errors, monitor performance, and improve the Service;
- comply with legal, regulatory, accounting, or security obligations; and
- communicate with you about the Service, updates, support, or relevant changes.
Capy does not sell identifiable customer message content or personal information to third parties. We may use information processed through our services to provide, maintain, improve, and secure our platform, and to generate aggregated, anonymized, or de-identified analytics and market insights that do not identify individual customers, leads, or conversations.
5. Legal basis for processing
We process personal data when one or more of the following bases applies:
- you or your organization has authorized Capy to provide the Service;
- processing is necessary to perform a contract with you or your organization;
- processing is necessary for legitimate business purposes such as security, support, fraud prevention, debugging, and Service improvement;
- processing is necessary to comply with legal obligations; or
- consent has been obtained where applicable law requires it.
6. WhatsApp and lead communications
Real estate agents, agencies, and businesses using Capy are responsible for ensuring they have the necessary permissions, consents, or opt-ins to communicate with leads and contacts, and to use Capy with those conversations.
This includes, where applicable:
- obtaining opt-in before contacting people via WhatsApp;
- providing required notices about use of CRM, automation, or AI tools;
- sending only permitted, lawful, accurate, and non-misleading messages;
- complying with applicable WhatsApp Business and Meta policies;
- promptly honoring unsubscribe, "stop," block, exclusion, or opt-out requests; and
- keeping accurate and up-to-date business information.
Capy processes WhatsApp Business data on behalf of the business customer that connects its account. The business customer is responsible for the final content of its communications and for compliance with laws and policies applicable to those communications.
7. How we share data
We may share personal data and Customer Data with the following categories of recipients:
- Meta / WhatsApp, as necessary to provide WhatsApp Business integrations and related services;
- hosting, database, storage, and infrastructure providers, to operate the Service;
- email and communications providers, to send notifications, support, and Service communications;
- analytics, monitoring, and error logging tools, to maintain reliability, security, and performance;
- AI service providers, when we use external models or systems to analyze conversations, extract information, or generate suggestions;
- professional advisers, authorities, or relevant third parties, when necessary to comply with legal obligations, protect rights, or respond to legal process; and
- successors or potential acquirers, in connection with a merger, acquisition, financing, reorganization, asset sale, or similar transaction.
We require our service providers to process data only to provide services to Capy or according to our instructions, and not for their own independent use, unless applicable law permits or requires otherwise.
8. Artificial intelligence processing
Capy may use automated systems and artificial intelligence models to analyze conversations, properties, and CRM activity, and to generate:
- lead fields and property criteria;
- suggested replies;
- follow-up reminders;
- lead classifications;
- conversation summaries;
- business analytics; and
- recommended actions.
AI-generated results may be inaccurate, incomplete, or unsuitable for a specific situation. You should review AI-generated suggestions before relying on them, especially before sending messages to leads, updating CRM records, making business decisions, or modifying relevant information.
Capy does not guarantee that AI-generated results are correct, complete, up to date, or suitable for every case.
9. Data retention
We retain data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, maintain security, and fulfill the purposes described in this Policy.
In general:
- Account data: retained while your account is active or as necessary for legal, administrative, or security purposes.
- CRM, lead, property, and message data: retained while the customer keeps it in Capy, while the account is active, or until deletion is requested, subject to legal or technical exceptions.
- Technical records and logs: retained for a limited period for security, monitoring, debugging, and abuse prevention.
- Backups: may retain data for an additional period until deleted according to our normal backup cycle.
We may retain certain information longer when required or permitted by law, for example for tax, accounting, legal, security, fraud prevention, or dispute resolution purposes.
10. Your rights and data deletion
Depending on applicable law, you may request access, correction, update, export, or deletion of your personal data.

Include, where applicable:
- email associated with your Capy account;
- business or agency name;
- connected WhatsApp Business phone number;
- description of the data you want deleted; and
- any information needed to verify your authority over the relevant account or business.
Before deleting business data or data linked to a WhatsApp Business account, we may require identity or authority verification to protect business customer information and prevent unauthorized deletions.

11. Security
We use reasonable technical and organizational measures to protect personal data and Customer Data against unauthorized access, use, loss, disclosure, or alteration.
These measures may include:
- access controls and authentication;
- encryption in transit via HTTPS/TLS;
- restricted database access;
- logging, monitoring, and alerts;
- secrets and credential management;
- backups;
- internal access limited to authorized personnel; and
- reasonable operational security practices.
However, no method of transmission or storage is completely secure. We cannot guarantee absolute security.
12. International transfers
Capy may use service providers and infrastructure that process data in countries other than yours, including outside Paraguay.
When data is processed or transferred internationally, we adopt reasonable measures based on the nature of the data, the destination country, our providers' safeguards, and applicable law requirements.
13. Children
Capy is intended for businesses, agencies, and professional users. It is not directed at minors and we do not knowingly collect personal data from children.
If you believe we have collected personal data from a minor without proper authorization, contact us so we can review and take appropriate action.
14. Changes to this Policy
We may update this Privacy Policy from time to time. When we make changes, we will update the "Last updated" date shown on the page.
If changes are material, we will try to provide reasonable notice when practicable. Continued use of the Service after changes take effect constitutes acceptance of the updated Policy, to the extent permitted by applicable law.
